These Terms of Service ("Terms") govern your use of our website (the "Site") and the services of Pearl Lemon Limited (trading as Highwater) ("Highwater," "we," "us," or "our"). By using the Site, submitting a form, booking an introduction call, or communicating with us, you agree to these Terms.
1. Use of the site and services
You may use the Site and our services only for lawful purposes and in accordance with these Terms. You agree not to misuse the Site, attempt to disrupt it, or use it to infringe the rights of others.
2. Intellectual property
All content on the Site, including text, graphics, logos, the Highwater name and mark, and design, is owned by or licensed to Highwater and is protected by intellectual property laws. You may not copy, reproduce, or reuse it without our prior written permission.
3. Communications and consent
By submitting a form or providing your contact details, you agree that we may contact you by email or phone in response to your enquiry and, where you have opted in, with information about our services. You can opt out of marketing communications at any time using the unsubscribe link in our emails or by contacting us.
4. Our service and disclaimers
The Site and our services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
Not financial advice
Highwater is not a financial advice firm and does not provide regulated financial advice. We are a marketing and appointment generation service for FCA-authorised firms. Nothing on the Site is financial, investment, tax, or legal advice. Where we arrange an appointment, we introduce a prospective client to an FCA-authorised firm; any advice is provided by that firm, and the decision to act on it is between you and that firm.
No guarantee of results
Any results, revenue figures, conversion rates, testimonials, or case studies shown on the Site reflect outcomes achieved in specific circumstances and are not a promise or guarantee that you will achieve the same or similar results. Appointments are introductions to qualified prospects; they are not a guarantee that any prospect will become a client. Outcomes depend on many factors, including your market, proposition, capacity, and the way you conduct the meeting.
How the appointment service works
Our service is sold in batches. One batch is ten attended appointments at £800 per show, totalling £8,000, payable upfront. An appointment is considered attended when the prospect joins the scheduled call or meeting. Appointments where the prospect does not attend do not count toward the batch total. We continue delivering until all ten attended appointments are complete. Appointments are held by video or phone to begin with; in-person meetings may be arranged later by agreement between you and the client. Each batch is governed by its own short written agreement covering that batch alone. There is no retainer, minimum term, or long-term contract, and buying a batch does not commit you to buying another.
Qualification and self-reported information
Appointments are qualified against criteria agreed with you before your campaign begins. Information provided by a prospect, including any figure for investable assets or pension savings, is self-reported by that prospect. We do not independently verify a prospect's assets, and we do not warrant the accuracy of the information a prospect gives about their own circumstances.
Non-attendance and refunds
An appointment where the prospect does not attend does not count toward your batch total. We continue delivering until all ten attended appointments are complete. There is no cash refund for the upfront batch fee. The remedy for any shortfall is continued delivery until the batch of ten shows is fulfilled.
5. Limitation of liability
To the fullest extent permitted by law, Highwater will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or our services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
6. Third-party links and services
The Site may link to or rely on third-party services, for example scheduling, forms, advertising platforms, and social platforms. We are not responsible for the content, terms, or practices of those third parties.
7. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
8. Changes to these terms
We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last updated" date above. Your continued use of the Site means you accept the updated Terms.
